Eagle Brook Church, a Minnesota non-profit (the “Eagle Brook or “we,” “us,” “our”) is committed to protecting the privacy of our members and donors (“Member” or “Donor,” and collectively referred to as “you,” “your,”) and the personal information you may share with the Eagle Brook or that the Eagle Brook holds. The Eagle Brook values your trust and recognizes that maintaining this trust requires the charity to be transparent and accountable to our stakeholders at all times. This Privacy Policy (the “Policy”) describes the information we may collect about you, and the Eagle Brook’s practices for using, maintaining, protecting, and disclosing that information. 1. Information Collected and Maintained. Eagle Brook collects and maintains information that you provide to us when you:

(a) Contact us by phone, mail, or email, in person, or via our website.

(b) Register for or check in at an event. (c) Make a contribution, either on our website through our third-party payment processors, at a special event, over the phone, or by mailing in a check.

(d) Navigate through our website.

(e) Engage with us through short messaging service (“SMS”).

From time to time, we may collect personal information from you in ways not described above, subject to your express approval.

2. Types of Information. Eagle Brook may collect the following types of information about you:

(a) “Personal Information,” including:

(i) Contact information, such as name, address, email address, and telephone number.

(ii) Your date of birth.

(iii) Your family information and marital status.

(iv) Information on events you attend and publications received.

(v) Any other information provided by you to Eagle Brook, such as public comments or posts on Eagle Brook’s website.

(b) Giving information, including types and amounts of donations, and where the donations were made. We utilize a third-party for any online transactions, which collects credit card information. Eagle Brook does not collect, store, or disclose credit card account information provided by you when making a donation.

(c) Information that does not personally identify you, including information that is anonymized, aggregated, or publicly available when not combined with non-publicly available information about you.

(d) Information about your equipment, browsing actions, and patterns, including information automatically collected through technical methods such as:

(i) Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our website. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our website.

(ii) Flash Cookies. Certain features of our website may use local stored objects to collect and store information about your preferences and navigation to, from, and on our website. Flash cookies are not managed by the same browser settings as are used for browser cookies.

(iii) Web Beacons. Pages of our website and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Eagle Brook, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

(e) We do not collect sensitive personal information about you. We do not assume that you are of any particular religious affiliation or are expressing to us any particular religious belief. We assume you are interested in the content we provide. We do not require users to provide information about such beliefs or any other sensitive data such as race, ethnicity, philosophical beliefs, sexuality, or physical or mental health.

3. Confidentiality. Your Personal Information and information about any financial and nonfinancial transactions between you Eagle Brook is considered confidential and we employ reasonable administrative, technical, and physical safeguards designed to protect it. While the information is kept confidential, it is shared with Eagle Brook’s board members, staff, and professionals on a need-to-know basis and in compliance with all laws, regulations, court orders, or other governmental requests. We may also disclose such information if we have good faith to believe that disclosure of such information is reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) investigate, detect, prevent, or take action regarding illegal activities or other wrongdoing, suspected fraud, or security issues; (iii) to establish or exercise our rights to defend against legal claims; (iv) prevent harm to the rights, property or safety of us, our users, yourself or any third party; or (v) for the purpose of collaborating with law enforcement agencies and/or to enforce intellectual property or other legal rights.

4. Use of Personal Information. Eagle Brook collects and maintains Personal Information to:

(a) Establish a relationship and communicate with you about Eagle Brook, including our programs, special events, and funding needs.

(b) Learn about you and what matters to you.

(c) Process donations and event registrations and issue annual giving statements.

(d) Comply with all laws and regulations, including reporting requirements.

(e) Plan future development activities and events.

(f) Analyze engagement patterns.

(g) Solicit feedback from you by conducting surveys.

We will only collect and process Personal Information about you where we have a lawful basis. A lawful bases includes where you have given consent and where there are legitimate interests. Such legitimate interests include: providing protection to you, us, other users, and third-parties; compliance with applicable law; to enable and administer our internal processes; help us understand and improve our internal processes and user experience. Where we rely on your consent to process your Personal Information, you have the right to withdraw or decline your consent at any time, and where we rely on legitimate interests, you have the right to object.

Eagle Brook uses reasonable administrative, technical, and physical safeguards to protect your Personal Information against the unauthorized access, use, alteration, or destruction of your Personal Information. Eagle Brook will not share, sell, or exchange your Personal Information with any other entity for third-party fundraising or marketing purposes, except as provided in this Policy or as expressly consented to by you. 5. Communications. Eagle Brook will from time to time communicate with you, including by telephone, text, email, and mail, concerning Eagle Brook’s charitable activities, events, and requests for future support. Eagle Brook will not call or email you or send mailings to you on behalf of other organizations. 6. Records Retention and Destruction. Eagle Brook complies with all Internal Revenue Service, state, and local regulations and Eagle Brook’s internal policies governing the retention, management, and destruction of the information collected and maintained by Eagle Brook.

7. Accessing, Deleting, and Correcting Your Data. For data that we have about you, including your Personal Information, you may request the following by contacting us here .

(a) Deletion: You may ask us to erase or delete all or some of your Personal Information. Please note that doing so may limit your ability to use certain functionality of our websites. Please note that an email address is required to have an account to ensure we can properly authenticate potential users of that account.

(b) Correction/Modification: You may edit some of your Personal Information through your account or ask us to change, update, or fix your data in certain cases, including if it is inaccurate.

(c) Object to, or Limit or Restrict, Use of Data: You can ask us to stop using all or some of your data or to limit our use of it. You can also opt-out of the sharing of your Personal Information.

(d) Right to Access and/or Take Your Data: You may receive a copy of the Personal Information you directly volunteer to us in a structured, commonly used, and machinereadable format.

Please be aware that Eagle Brook may not accommodate a change request that would impact record retention or other operational requirements like remembering email opt-out preferences, violate any law or legal requirement, or cause the information to be incorrect. Deleting your Personal Information may also require deleting your user account (if any).

8. Changes to the Policy. This Policy is current as of the date stated at the top of this Policy. Eagle Brook reserves the right to amend this Policy from time to time. Eagle Brook will notify you of any material changes to the Policy through a notice on the Website home page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our website and this Policy to check for any changes.

9. Children Under the Age of 18. We do not collect Personal Information from any person we know is under 18 without the consent of that minor’s parent or legal guardian. Eagle Brook’s website is not intended for children under 18 years of age, without the express consent of the child’s parent or guardian. No one under age 18 may provide any information to or on the website without such consent. Eagle Brook does not knowingly collect personal information from children under 18 years old without the prior consent of the child’s parent or guardian. If you are under 18, do not use or provide any information on this website or through any of its features, register on the website, make any purchases through the website, use any of the interactive or public comment features of this website, or provide any information about yourself to Eagle Brook, including your name, address, telephone number, email address, or any screen name or user name you may use without your parent’s or legal guardian’s consent. If Eagle Brooks learns it has collected or received personal information from a child under 18 without verification of parental consent, Eagle Brook will delete that information.

When you associate your minor child’s information with your account, you consent to our processing of that information in accordance with this Policy and other privacy notices and terms we may provide to you from time to time. If you allow your minor child to use our sites, we ask that you discuss the risks of sharing Personal Information on the internet with your children and require that they refrain from communicating with any third parties or sharing any Personal Information with other users.

10. Collection of Information Through Use of a Third-Party. This Policy applies only to sites and apps owned and operated by Eagle Brook. Our sites may contain links to other websites or apps, and we use a third-party to process online payments. You are responsible for reviewing the privacy policies of those third-parties, and on any other websites you choose to link to or from through our website to understand how those websites collect, use, and store your information. We are not responsible for the privacy statements, policies or content of other websites or apps, including websites you link to or from our website. As of the date of this Policy, we use PushPay, MyWell, and Secure Give to process your online donation payments. For information on how each of these entities processes your information, please refer to their privacy policies found on their websites.

If you link to other websites, applications, and services or profiles you have with third-party applications, you may provide the data stored on those applications to us. For example, you may link your Facebook account to your profile, providing the Personal Information you have opted to share through Facebook to us. When you do so, we are provided with your Facebook or other applicable social media username. You may revoke the link with such accounts and third-party applications by modifying your settings with those applications. As noted above, third-party sites that link to or are associated with our sites may collect information using automated technologies such as cookies. We have no control over such collection and use, which are subject to the privacy policies of those third parties.
